Yes, it is illegal. But to arrest the scammer you have to find him. Long distance calls have gotten so inexpensive many of the scams are being run from outside the US, many in 3rd world countries where scamming dumb Americans is not illegal and the local police do not cooperate with US law enforcement. They cannot be caught. Even the few still operating from the US catching them is not top priority.
