The gentleman that called said his name was Daniel from the Attorneys he stated the case number then his phone number and said that that was a legal matter that we had to call back he didn't explain what the legal matter was about.

This is a common ploy by criminals attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this,  all for an alleged or nonexistent debt.  They also use the “process server” who calls and claims he is going to serve you, but then says you could avoid it by calling another number.  Now why would a “process server” want to do you, a stranger, a favor, and at the same time not get paid to deliver the papers?

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Same thing a caller named Daniel told me I would be criminally charged if we didn't resolve the dispute. He first said it was a debt for $60 from 2008. Statute of limitation is 7 years and since I have been receiving these calls (3 times now) I called my local PD fraud department after the second time and the detective said the DA will not go after someone for such a small amount that long ago. i then proceeded to call him out for what he was (scammer) and he said he was a legitimate collection agency which the whole time until then he was saying he was an attorney. Hit one. Gave me addresses that don't exist. Hit two. 7years ago for $60. Hit three because another scammer called me up a month ago claiming I owe them for the same company the same amount. And the fact that he said well if yo I'm not going to get a payment then I will proceed with criminal charges. Hit four. A reputable collection agency knows it's against the law to threaten someone with prosecution of criminal charges which leads to jail time.

All they can do is send you a written letter to your house upon your request. Which by law they are required to do once they have contacted you
