received a call about an old payday loan said if i didnt pay the original lender had authorized them to prosecute on the grounds of malicious intent something or other having to do with fraud, said i would be served and most likely arrested and it was a felony!! WTF I'm kinda freaking out! the name of this company was Century Processing Group out of St. Louis,MO
First off, no legitimate process server contacts you in advance and tells you they are coming by. They just show up.
Secondly fraud is a crime and only public prosecutors and police handle the investigation and prosecution of crimes. A felony, if one has been committed, is handled by law enforcement. Debt collectors have nothing to do with law enforcement.
Thirdly, being in ordinary civil debt is not a crime and you cannot be arrested for it.
Fourthly, If you had commuted a crime, you'd be aware of it from local law enforcement. You wouldn't hear about it from some scammery-scummery debt collector.
They are just trying to scare you.
Just because a voice on the telephone claims you owe a debt does not mean you owe it
If a voice on the telephone claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else a DIME until the debt is validated.
Of course they won’t do this, no scammer ever will, so simply block their calls and ignore them.
If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. You might have to yell at the scammer and talk over him or her. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now. If you can find them.
Yes this company called me and told me I owed money from a payday loan from 2013 I was told it is a felony and I would be arrested. I was told it was a restraining order from the company and I could not contact them I was put on hold and then talked to two other people. I was given some number and told to go to western union when I asked what the name of the company was he said I told you when I first had to on the line. Strange Strange people talking fast and just talking nonsense.
OMG thank you so much for this info I was freaking out too because they had some specific info about this old debt that I owed and they had all my info date of birth last four of my social and everything but I knew it was a scam when I asked them to mail me some paperwork and the guy said it's beyond repair at this point!!!!! but i just wasn't sure if anyone else got a call like this so thank you so much for posting this and I am certainly going to report them! Good job!
I also received a call from this company claiming that I had some fraud charges that are being filed against me and that it was from a payday loan and they had me on the surveillance camera writing that check!!!! anyways I kept asking them to give me their names or send me some letters in the mail and they said at this point it's beyond repair and all this other bs but they said their name was FINAL PROCESSING COMPANY!!!! I called my local police department and they said debt collectors have n o authority to file criminal charges against nobody only law enforcement can handle that stuff so it's definitely a scam!!! but they did have all my info last 4 of my social, date of birth and they claimed they got my number as an emergency contact number from someone else's application!
