called said it was some company call excel collections service. It was automated message with a file number. saying to call back this number: 18662453977 or press 1 to speak to representative.
by law, the collection agency can only call 3 times per week and only between certain times of day, which does include saturday. They are not to call past 8 or 9 pm during the week and not to call past 5pm on sat. no calls on holidays. just because they have a ref# does not mean anything. In most provinces, once the debt is past the 2 year mark .. its basically written off by the collection agency. they can try and collect all they want, but you are not required to pay and it should be taken off your credit rating. although, if you do make any kind of payment on the debt, the cycle start all over again. Example .. it's been one and a half years since you've made payment and you decide to put $1.00 .. the one year and a half cancels out, and it starts all over again.
I've gotten a call from them for a debt that has no meaning .. something about cleaning fees for the place we used to live at. Unfortunately for the agency, they're documents have no leg to stand on. We requested documentation and funny enough the guy emailed them to us. On one of the docs it clearly shows that this doc is NOT TO BE SENT TO COLLECTION AGENCY .. and the other docs, where I have the original from when we moved in. (it's an inspection that gets done on move in and then again when you move out) has discrepancies. They show that they've inspected a 3rd bedroom .. when the unit we lived in was a 2 bedroom. They also state about basement .. we didn't have a basement.
As far as getting calls and the person they are looking for does not live there any longer shows that they did a reverse search on the address and found your #. Send them a cease and desist letter, registered mail .. or by a courier service where they have to sign for the letter and you are provided with a tracking # telling them to stop calling as the person they are looking for no longer lives at tht location. If they do persist with the calls, you will be getting a lawyer and sue them for harassment. Also would be smart to search the debt collectors act within you province and quote anything that is pertinent.
