And btw, like someone above said, if you don't think you have debt you need to double check...what he owed on that car NEVER showed up on his credit or anything. So ya'll just be sure and take care of it, if they do the same thing to you like they were going to do to him and put a lean on you....that means you can never own a house, another car....ANYTHING. Be careful and take care of your business. The reps are mean because they get cussed out all day, but after my husband told them he was a nice guy and was going to work with them, they were tolerable after that.
If you people would pay off your debts in a timely matter and not try to cheat the system out of thousands of dollars then I wouldn't have to harass you incessantly at inconvenient hours! In fact, you could make things easier and just never take out any loans and pay for everything up front in cash! But then I wouldn't have a job. So thank you.
The answer is not to "take care of your business" as the collector demands, but count their FDCPA violations:
} "mother in law got a call from a VERY rude lady"
Skip tracing relatives under false pretense of being unable to find the alleged debtor, sufficiently rude conduct can rise to illegal abuse
} "pay $6,000 today, or they will put a lean on him and serve papers"
The term is "lien", and this was an extortionist tactic. If SoL has expired this misrepresents the legal status of the debt.
} "they said he ACTUALLY owes $15,000, but they will just take the $6,000"
Amount claimed likely inflated, misrepresenting the character of the debt
Now we'll count the shill points:
} "lean on you....that means you can never own a house, another car"
No, it means there's a lien on ONE item of property. State laws vary on what happens next. Someone seriously underwater with no other option can always try a bankruptcy filing and rebuild credit.
} "The reps are mean because they get cussed out all day"
No, "the reps are mean" because it's easier than finding proof of claim and they secretly enjoy it.
} "after my husband [became deferential] they were tolerable after that."
I see, so everyone was happy to forgive abuse of family members, cheap scare tactics, and a pattern of lies once a Dynamic rep shifted down to "calm mode". Next time I'm short on rent I'll be sure to call your house and cuss you out, then make a fake apology. That seems to work well on you.
Rule #01: Lawbreakers don't get paid. Below are links to help educate you on federal collection practice laws.
A little education for those being harassed by this bottom feeding junk debt buying collection agency. You are in control. 1. Tell them you don't talk bills over the phone. Tell them to Mail you any info. Hang up. 2. Certified Cease and Desist letter ends the calls. 4. After the 1st call they have 5 days to mail you and they must tell you of your rights as a debtor. 5. know when the last payment was made on the debt. That's when delinquency began. 6. If it's past the SOL to take you to court which it usually is your done. They can't call you. The letter took care of that. They can't sue you. The law has taken care of that. Blow off the threat about the IRS coming after you. It's a scare tactic. It's the final scam when someone knows they don't have to pay on an old debt past the SOL. NO the IRS will not be knocking on your door. Portfolio Recovery one of the most notorious scum bag collection agencies has been severely popped for pulling this routine. Understand it is a crime for anyone to threaten you with liens, wage garnishment or suggesting the IRS will strong arm you. In fact the IRS should file charges against such claims. That simply does not happen like some Nazi regime out of nowhere. The only thing that happens is a tax is applied to the original debt amount. Nothing happens to you financially until after you file your taxes. Once you apply your income and deductions for that year you may owe zip. You may be able to prove at the time they filed with the IRS you had more debt than assets and won't have to pay a dime. They may file the wrong original amount and this gives you another opportunity to claim they are frauds and again you don't pay a cent. The tax is usually so small it's nothing. Your refund easily covers it with some left over. What happens to the company? They lose. They got nothing from you. If their amount claim is incorrect they are in big trouble. And here's the best part. By closing your account no one ever ever ever ever ever can call you about this debt again. It's done and over. So tell them.. contact the irs but you better have complete proof on the original amount because if not I'll take you down and I'll have multiple ways to avoid any payment. So shut the eff up about the IRS being some thug. You're the lying thug. The days of Junk Debt Buyers are numbered. Have you seen some of these losers and the nasty scum life's they live? They are con artists. The operators are as bright as a two watt light bulb. Usually the women have been popped for welfare fraud or they do drugs. The men are felons, drug abusers and alcoholics.
