The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.
received this same email threatening action. It's all a joke and it's unfortunate that several people fall for this each year because they are too scared of possible consequences. Below is the email that I sent them in return and would recommend something along these lines for you. Scare them back and they will stop harassing you.
I appreciate your effort to scare my family and scam us out of money. However, this tactic WILL not work with me as I have several years of law experience and can tell you that you are in direct violation of several aspects of the FDCPA ( that would be the Fair Debt Collection Practices Act if you are unaware.) I am not, nor have I EVER been in default on a payday loan nor have I committed check fraud. Be advised that I am turning this email over to my attorney, and will also forward along any and all voice mails that you have left. In addition, I will be making the FBI aware of this as well. I am politely advising you at this time to cease and desist from any further communication, either electronically or through the means of a phone call. If you wish to file a lawsuit in regards to this matter, please do so and be forewarned that I will countersue for not only the violation of my rights, but for defamation of character, slander, and anything else I deem necessary. This is your warning.
