This guy calls my daughters phone and leaves a detailed message for some guy we have NEVER heard of. He left his name, but of course it sounded like he had marbles in his mouth when he said HIS name. He went on to give a Case No and said that he needed to a call back so that this information can be given to the attorneys and then ended the call with "Please note, all calls are documented for future reference." He left an 888-978-4314 number for a return call. Soooo.... I called the number that was incoming (214-380-2020) and he answered. I asked him if he was Mr. Copacall or whatever the name was and he immediately wanted to put me on hold but I refused and I asked him if he had ANY idea of who he was calling. He said the name of who he was looking for and I proceeded to let him know that he had in fact reached my daughters phone and she has an anxiety disorder. The whole time he was trying to talk over me and I wouldn't allow it. Then, suddenly he said "I don't have time for YOU. Call me back on a different day!" and HUNG UP! NO NO NO! I know he just didn't do that.... so... I turned off the caller ID on my phone and I called the 888 number he had left on the original voice mail. He answered.. I asked "Is this the guy I was just talking to?" His reply, "No"... I said, "You mean YOU"RE not the one that just told ME that YOU didn't have time for ME and hung up on me?" He then replied "I am in a meeting" and hung up AGAIN!!!! Seriously????? I have done some research. This guy is on the verge of a lawsuit .

I have successfully sued collections agencies like this. The Fair Debt Collection Act allows them to call you between the hours of 8 am to 9pm (your time). If you tell them to stop calling they don't have to, you have to either write them a letter and mail or fax it to them, stating that you don't want them to call you anymore. Or get a lawyer and sue them. I live in KY and the law allows you to record a phone conversation as long as one of the parties is aware it's being recorded (you). You don't have to tell them, but if you do record it, make sure you say you are if you want to cover your rear end if you live in a non-recording state.
Your letter should go like this:
Dear sir,
In accordance with the Fair Debt Collection Act, I am requesting you to stop all communications with me by any means or media. I don't owe this debt and I am not responsible for it. If you continue to harass me I will be forced to file a Federal Lawsuit seeking $1000 for each time you attempt to call me or write me.  I have retained the legal services of an Attorney and he has advised me to contact him the next time you attempt to contact me.

Sincerely,
John Doe

This letter works because I have used. This company tried to get me to pay an old $50k 2nd mortgage, I told them I was the victim of fraud by EMC Mortgage and I received a settlement in the recent suit agains this company. I really did, I got a big fat check.
