Called at work twice, threatened 'court action', on a supposed debt from a bank I never heard of, let alone did business with, that was from 1996. The statute of limitations for a credit card debt in Texas is four years. About 2 weeks later, had voice mail from the same company, called back, and before the woman could start talking I gave her the information, that the debt was over 20 years old and the statute of limitations was four years. She apparently didnt even know what a statute of limitations was. Sheesh!
These people call my cell, my husbands cell, my moms home and one of my brothers home phones. They are claiming to be Capital Indemnity Solutions and I will be served at work or home. I finally called back once to tell them to send me the info backing up their claim. I was told I'm wasting their time and if I call back they will send me to the sheriffs office. I asked please send me there so I can know what is going on. Of course then they hang up. I still am receiving calls but no messages. I have reported to no call registry and bbb. Fcc won't take this type of complaint. I am at my wits end especially since they call my elderly mom almost everyday. I have yet to block this one since my mom has been involved.
A Brittany White left me a msg, said she's with United Restitutions,State of Texas and have file a claim against me that I can "settle out of court" by calling them back
Well hold your breath cause no way I'm calling back...scammer
every time I block one phone # they only call from another...ugh been going on for over a year.

SOL has to do with the time they have to sue you, not the time they have to collect the debt. Now here is the problem. After they called you the first time, they were required by law to send you a letter. I sounds like they didn't. So that is their first FDCPA violation right there. Continued collection activity the second.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
