Also there is no bad check they use that as a scare tactic the worse thing that can happen to u is a judgement and that's probably not going to happen because they have no attorney representation
I've received multiple calls to my home phone from Mr. Steven Scott (so called lawyer), and his associates. They have made harassing calls and threatened numerous idiotic things, such as warrants, suspended licence, and ruining my credit, just to name a few. I DO NOT, write checks! I called my district attorneys office to ask about their threats. I was informed that I DO NOT HAVE ANY WARRANTS or HOT CHECKS. I them made a call to the Better Business Bureau, and filed a complaint. Furthermore they recommended that I do know deal with these people, that yes, indeed, it is a SCAM, and to just hang up on them. I will also be making a call to the phone company to see about blocking this number and any other numbers they call from. *Funny fact, the Bbb said they would be making a call to them! Don't fall for their tricks, they like to prey on the weak, in hopes of taking your money.
Upstate Management and Arbitration Services called me from this number telling me they were taking me to court and that they would place a hold on my IRS return if i was going to receive any and that i would be charged w bad check.
As a rule there are only three entities that can directly garnish your federal tax return legally. That is the government, the Department of Education and your State Revenue Service. The government can retain your refund if it finds that you owe any back taxes to the federal government. The Department of Education can garnish your income tax return for past due amounts on federally backed student loans. You state department of revenue can garnish your income tax refund for state taxes that are due or for student loans that are guaranteed by the state. All three of these entities will notify you with their intention of keeping your refund.
Can A Bill Collector Garnish My Income Tax Refund?
A bill collector can not directly attach their debt against you to your income tax return. However, bill collectors can indirectly gain access to your refund by getting a judgment against you. Once the judgment has been awarded they can request the court to issue a seizure on your bank accounts. If your income tax refund has been direct deposited into one of these accounts the creditor can seize the funds through this court order.
