The president of FMA Alliance is named Michael Janakes. According to the Harris County Appraisal District website (hcad.org) Michael Janakes home address is:
JANAKES, MICHAEL
3511 CREEKBRIAR DR
HOUSTON TX 77068-1310
Do with this information as you will. It is all public knowledge if you know where/how to look. I do know that if FMA does not stop calling me for fictitious debts Mr. Janakes will get the opportunity to explain it to me personally. I anticipate a short conversation.
This company calls me 2-3,sometimes more a day. I have told them on more then one occassion that the party they are looking for is not at this number. They continue to call. The fact that they have called me from several different phone numbers becomes harrassment in the state of Texas. I will take action if this does not cease.
"ITS NOT A SCAM IF YOU KNOW THE LAWS THERE ARE GUIDELINES WHICH NEED TO BE FOLLOWED BEFORE ANYONES INFORMATION IS GIVING OUT..... HOW ABOUT LEARN THE FACTS FIRST AND HALF OF THE TIME ITS THE CORRECT PERSON JUST PRETENDING TO BE SOMEONE ELSE."
You sound like one of those incompetent service reps, especially with the bad grammar and spelling. Anyway, I do know the laws but it sounds like you don't. You're correct that there are guidelines (and federal laws) restricting how much personal information is "GIVING" (you probably meant "given") out on these calls. For this reason, if they call and ask for someone, and if I tell them I am not the person they are trying to reach and that they have the wrong number, then they have to stop calling me. Otherwise they are continuing to share someone else's protected and private financial information with me. Just the fact that a person has a debt with a particular company is legally protected private information.
It doesn't matter if the customer service rep thinks you are lying about your identity. In addition, if you are in fact the person they are trying to reach, you can notify them in writing that you want them to stop calling you. It's best to send a notarized letter via certified mail that requires a signature. This is especially true if you have gotten a lawyer to handle any disputes you have regarding the alleged debt. If you do have a lawyer, get the lawyer to write a letter to the collection agency stating that any future communication with their client (you) should be directed to your lawyer. They have to comply with this. If they do not, there are state and federal penalties and fines for this.
Collection agencies are contracted by the original company that you allegedly owe money to. Sometimes they're actually part of the original company but they use a different name. If they're a contracted company, the collection agency usually only gets paid (or at least they get paid more) if they get some money from you. They always have the right to report your debt to the three credit bureaus, but they don't get paid for this.
They call from this number constantly, but we never answer calls from numbers we don't know. They called repeatedly without leaving a message. Finally, we answered and they refused to give me any information until I verified my social, date of birth, name and spouse name. I hung up and they called back twice in a row after that. SCAM!!!!
These people call about 4x a day for the last 3 months. I have asked them to remove my name from their list at least 6 times and still they call!! I can't even pronounce the name of the person they are looking for, it certainly is not me or my husband!
FMA Alliance is the caller and they are aggravating. Called and spoke w/Pam and had her remove my number from their database since I have no idea who they are. Unfortunately the person who had my # before must not pay their bills.
