Told me I had a summonse to appear in court. Wanted me to write down a case number and phone number to call the company holding my file. Told her I was driving she said she would call back and leave me a voicemail, but never called back.
I first received a call from a 'Stephanie' from the Department of Civil Procedure (302-255-0805) and she advised me that there is a pending civil case against me and they are trying to send me the summons to court. My Caller ID popped up saying the call came from 'State of Delaware'. 'Stephanie' told me that I needed to call this number (855-731-2916 Schwartz & Assoc) and gave me a case number to reference. I contacted this phone number to find out whom I needed to speak to. They told me my case manager's name is Trevor McCall and they transferred me to him. I was on hold for quite a bit before he answered. I did make sure to record the conversation so I could forward it to my attorney and the proper authorities.
Trevor began to tell me that I have a pending civil case for a Capital One credit card account that I had opened back in 2008. I had not filed bankruptcy by that time and my credit was so bad at that time there is NO WAY that any credit card company would EVER give me a card. He then asked me for my full name, address and social security number. HELL NO did I give him that info. I also made sure to ask for as much detailed information from him as I could. I got him to tell me the account number for the credit card (I checked my past credit cards and current and I never had this card), the exact date that it was opened and how much was owed ($1816). He told me that they will issue the summons to appear in court to me on Monday. I then asked him to repeat the info he gave me to insure that it was all recorded on my end. He then asked me if there was any other info I wanted him to provide me so I told him "No and thank you for all the detailed information and that this conversation was recorded and will be given not only to my attorney but to the proper authorities". He said some choice words and then hung up on me. Gee, I wonder if it was a scam.
Please don't be a sucker and fall for this scam. I can only imagine how many people have given these people their full information and then had their identity stolen.
I have contacted my attorney already and forwarded the recording and he put it in my file as well as passed it on to the Police for a report to be filed.
I also contacted the actual law firm of Schwartz & Assoc. so that they are aware that their firm's name is being used for fraudulent scam calls. She advised me to make sure to report it to the Federal Trade Commission for an official report. Report them to the Federal Trade Commission by submitting an electronic version of your experience and to be as detailed as possible. FTC.GOV is the web address for the Federal Trade Commission.
