No sir. If they don't try to sell you anything they haven't violated the DNC list. Silence can not be construed as an attempt to sell.
The people who run the DNC Registry are pretty fed up with complaints about calls that waste their time because they're not DNC violations:
Call but no message
Call and hang up
Call for charity
Political call
Cally for poll/survey (though the DNC people are wise to the scammers that pretend to be pollsters and ask a couple of lame questions before starting their cruise/timeshare/condo/etc. pitch)
