TOTAL SCAM. Lynn Hollister @ ext 407 called and left me a message threatening a lawsuit from an old payday loan that WAS SETTLED over 3 years ago directly with the lender, for which I have all documentation. I simply asked Lisa who answered when I called back to provide me with documentation of their claim at which point she became irate and combative to the point where she hung up on me twice. These people are bottom-of-the-barrel scum who are trying to dupe people into giving them money by recycling OLD, SETTLED debts. Don't give them any info, just tell them to provide you with proof of their claim - which they CANNOT and WILL NOT do because they know these debts have already been settled. Total scum, total scammers.
You do realize that the payday lender sold your information to them don't you? Attempting to collect on a debt that doesn't exist is a violation of the FDCPA.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
