Even if you are a business, or publish your number for the whole world to see, it is not legal to harvest your phone number or your email address and then call or SPAM you.
I am a business and there is such a thing as the OSHA and Safety manager. Osha is Occupational Safety and Health Administration and writes the Codes of Federal Regulations that business employers must follow for worker safety. Usually, the Safety manager of the business oversees this.
So, doesn't matter if your a contact for that business and they find your number and think they have a good chance to sell you something..... if that number is on the no call list, they shouldn't be suprised by anyone who answers the phone.
Shame on them. It will cost them big dollars to fly to Colorado. Have my Summons and Complaint being typed up now.
2. Exemptions from the National Do Not Call Registry
Not all solicitation calls are covered by the Do Not Call Registry. It depends on the type of call being made. You can still be contacted by:
Charities
Survey researchers
Political campaigns
Companies with which you have a business relationship (YOU CANT MAKE UP ONE TO JUSTIFY CALLING SOMEONE)
Companies to which you have given written consent to remain on their calling list.
Companies with which you have an "existing business relationship" as well as their affiliates can call you within an 18-month window. And when you inquire about or apply for a service or product, that company can contact you within three months.
YOU HAVE TO PROVE THE PERSON YOU CALLED CONTACTED YOU..... FROM THE NUMBER.
THAT MEANS YOU BETTER PRODUCE YOUR PHONE BILLS MATCHING THE PERSONS PHONE BILLS.
If you file a suit against these numb nuts... Get a Supeona Ducas Tecum from the Clerk of the Court and ask for all phone bills, all marketing sign up sheets you signed, ALL LEGAL SIGNED NOTARIZED CONTRACTS THEY HAVE WITH AFFILIATES, all Web page submission requests including IP addresses etcetera... It's called Discovery and they should bring it and give you a copy but I am sure they will conveniently leave it out and just say you phoned them. Ask for it. If they don't provide it, they are in contempt of court. They cant bring it later either. This Supeona is an order to produce Documents.
This way you can force them to prove you called them. I know I did not and they will play hell proving that. I will ask for all of the above so they cant say I signed up with Cocoa Puffs and they got my number from there through a business affiliate relationship. OK, PROVE IT.
I've received about five calls from a woman there asking for the owner of the company, regarding osha. she wouldn't tell me anything else, wouldn't give me a number to call back. Glad I checked it out, no point bothering my boss!
I have put much thought into whether i should even write this after finding a site like this. But I have decided after working for cascade callworks for almost 4 years and being fired because of someone who was subsequencely fired for exactly what I was complaining of that got me fired that there is no justice for the justified, no devotion to the loyal, no glory for the proud and, therefore, should be no warmth for the cold hearted in that company. It would be said I got fired for being late one less time than the many before me, bubt it is unsaid that I lost that job I once was proud and believed in because I rebeled against the favortism and unprofessionalism of a manager who was eventually "let go" for precisely those issues. Ironic? Hypocritic !
And then I was singled out under my nose for another bit of unprofessionalism that I must admit I was as much guilty of as the manager, Tina Boltz, who I was found to be sleeping with even though the company never found out we had actually had sex in the company break room and in the company parking lot. Aftera 3 year affair that ended Tina's marriage after I was "let go" and not accessable enough to her she moved onto another employee, Mike, which ended not too long ago thereafter she moved onto 2 other men I know of. Unprofessional? Cascade Callworks is run rampid with company relationships. Even though I never let it effect my production I felt descriminated against though moment the rest of the company found out about mine and Customer Service Director Tina Boltz extramarital affair. Hypocrits? I'll tell ya, Tina Boltz told me that owner, Shawn Shurstead's, marriage was ended after he started having an affair with his assistant. Where are the committment to employees, rules of conduct or even values in that company?
I used to be one of that company's top producers, most proud employees and even tried to go back there because of my unwavering dedication to loyalty. Well, I guess NOW they can call me "disgruntle". Have a nice day!
