I received messages with the same automated VM "being filed in your county, this is your last chance, good luck." Then I finally answered 'pressed 1' and talked to someone, who couldn't send me anything in writing. Then I was transferred to Investigator Brandon Robertson, who said that I owe $1800 with interest, but that he could "see if he could get some fees taken off" for a loan that I took out for $200 in 2012. My bounced NSF fees at my old bank constituted as bank fraud and they would be filing the order today in my county, AND that they would put out a search .
Once I was sued for 1,000 for not paying back a loan (financial troubles). I paid $200 to their lawyer, then supposedly it went to court, and it was resolved that I didn't owe anything else. I think the atty. told the judge that I had already paid and in good faith.
However, I found this:
I found this:
Collection agencies who specialize in collecting payday loans often throw around threats of prosecution, warrants, or other serious charges in order to pressure debtors into making payments. Not only are these threats fales, they are VERY ILLEGAL. Such threats are clear violations of the Fair Debt Collection Practices Act.
They cannot charge you with a felony. They cannot issue warrants for your arrest. Further, they are not in contact with the District Attorney and the D.A. will not pursue criminal charges. While writing a check on an account with insufficient funds and passing it off as a good check is fraud and can be prosecuted criminally, this is not what happens when you get a pay day loan. The check you gave the payday lender was a post dated check that everyone knew was not good at the time you wrote it. You did not misrepresent anything.
You can, and should, call my office or another attorney who handles FDCPA claims. You may be entitled to compensation including statutory damages of up to $1,000, actual damages, and attorney fees and costs. Payday loan collectors use these tactics because they work and not enough people stand up for their rights. Filing such a suit can be done with no cost to you.
In the meantime, you need to start keeping good notes. Make a note of every time you are contacted by this collection agency, who you talked to, and what was said.
Another "govern yourself accordingly" scam call. Asked for my mother, she's been dead since 2007.good luck with that one. Hung up on me when I told them that she was dead. Another scam...AGAIN!
They keep calling. They say they are from Financial Affairs.....hahaha! I don't owe money to their freaking scam company. They are putting out the warrant for my arrest to go to debtors prison. Really? ?
A real debt collector leaves a proper message, stating their name, and your name and states the company they represent not "District 117 I need to speak with you today". These scammers just constantly change their numbers and continue to call. Another blocked number to add to my long list of blocked callers! Its seriously out of hand!
Same as everyone else, this is getting pathetic. Do they think you are that crazy. They stated what everyone is saying. Giving no name, and not asking for a person.
They called me and said I borrowed money online and could settle my debt for 1500 but I had to pay 260 today or else I would be summoned to court and arrested on felony charges
