"PG&E user, PG&E is raising rates" and "do you want to save money". At that point I hung up. Obviously they are selling something and just dialing random numbers in the PG&E area. I am in and have been registered in the DO NOT CALL list since day one but these unwanted calls continue.

This information is provided as a service to all who are receiving illegal robocalls that begin with "Attention public utility customers: PG&E may be raising utility rates".  This telemarketer had been calling approximately once per month since early 2010.  Starting in late November 2010, they are calling multiple times daily.  Each call is a violation of the federal Telephone Consumer Protection Act.
This law allows compensation of $500 for each call received and the information provided here can be used to file a suit to collect damages.  They are violating another federal law by calling numbers on the National Do Not Call Registry.  Please report all violations at www.donotcall.gov.

If you transfer to the operator at the end of the robocall, she currently tells you that the company is Advanced Conservation Services with a website of www.utilityprogram.org.  The other information here was easily found using only free websites.

Advanced Conservation Services is owned by Michael Phong Nguyen, 42, of Sacramento.  Roger Gordon Kilby, 49, of El Dorado Hills is a vice president.  Kyle Gordon Kilby, 23, of El Dorado Hills is a regional sales manager and online spokesman.  Note that Elite Conservation Services is the former name of Advanced Conservation Services and the two names are used here interchangeably.

In July 2007, Michael and a previous company he owned settled various charges brought by the San Francisco District Attorney's office.  He paid a judgement of over $27000 and agreed not to engage in the behavior stipulated in the agreement.  Recently, the Contractors' State License Board filed an accusation against his contractor's licenses after receiving complaints from at least 10 individuals.  In addition, the company has a BBB rating of F.  Recent negative articles about them have been published in the Santa Cruz Sentinel and on the CBS5 (San Francisco) website.

The company may have an office at 1106 Windfield Way #2 El Dorado Hills, CA 95762 but it has not been verified.  A previous address was 4229 Northgate Boulevard, Suite 6B Sacramento, CA 95834.  The frequently used address of 2701 Del Paso Rd. #130-360 Sacramento, CA 95835 is a UPS mailbox.  All addresses outside of the Sacramento area, including those in San Francisco and Burbank, are UPS mailbox locations.

Unfortunately, a useful web article by CBS5 San Francisco has been deleted.  The following quotes are from the article:

The company was also accused of misrepresenting to consumers that contracts were simply applications, and of making false threats of mechanics liens and foreclosures. "We highlighted what I would really call a dirty playbook by this particular company" said Max Peltz [San Francisco ADA]. The court entered an injunction against Nguyen to stop that conduct, but Peltz said complaints he's now hearing from other counties make it appear as though the company "is certainly very brazen in light of the injunction that we entered."  Nguyen did not admit guilt in the case but paid a $28,000 fine.'

SOLICITATION CALLERS INSINUATING THEY ARE PG&E OFFICIALS

A web search of the phone number 415-738-0645 whom called my home phone today exhibits many, many complaints about these callers. They are deceitful about whom they are, and refused to identify their company to me, telling me that “the technician who came to perform my energy audit would have identification”    WHAT ?  When they told me they could call me because they are a non-profit, I asked for their name and non-profit number and they hung up on me.

They have called my elderly mother at her Alameda County home while I was there this past couple months. She uses a speaker-phone.  The conversation was very misleading and dishonest, just short of saying they were PG&E, and once my mother spoke and they heard her “older” voice, they were basically demanding to get her address and schedule her “PG&E REVIEW VISIT”.  When I took over the call and tried to get more info on whom they were, they refused to provide any data.  I told them she was listed on the do not call list, never to call her again, and to remove her number; they then hung up on me.   A week later when I was at her home, they had called back and left her two messages, asserting that it "was urgent for her to schedule her PG&E review visit".  My mother thought this was for a required visit, to keep her power on.

If numerous website data / allegations are correct - these no-goods have apparently perpetrated this criminal activity in other counties and have been fined?  This needs to be assertively addressed with stiff criminal charges, huge monetary fines / taking possession of their assets,  and absolutely some period of incarceration.  

Families have plenty enough to manage when caring and watching out for older family members, without the worries of activities like these being repeatedly perpetrated under the guise of being part of PG&E, and particularly being so aggressively targeted upon the elderly.  

I have provided this data to  the FCC, my local district attorneys office and also PG&E’s legal offices  - if anyone with any legal authority to stop these no-goods is reading this website – PLEASE  stop these criminals that prey upon the elderly !!!!
