What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
use threats of violence or harm;
publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
use obscene or profane language; or
repeatedly use the phone to annoy someone.
I owed a hospital bill to Park West Medical Center and was making payments on it. After 3 months of making "arranged" payments, the hospital turned it over to CBET in Morristown for collection. CBET immediately sued me. I was unable to appear at the hearing because my son-in-law is active military and was being deployed that day to an undisclosed location. I was not going to let my daughter go through this alone, so I missed court. Later I filed papers with the court and made arrangements to make monthly payments. I missed a payment, and CBET took me back to court and more than $500.00 was added to my account because of very high interest rates (predatory lending). I have made payments for more than a year but have missed 2 because my income was reduced. Now they are calling my employer and making threats.
It is ILLEGAL to discuss your problem the a third party. I suggest you contact an attorney regarding this. I wonder if you are really paying the company you think you are paying!
