THESE PEOPLE ARE TRYING TO RIP YOU OFF DO NOT TRUST THEM. called me and said they were going to file suit against me on behalf of bank of the west, if i did not pay the pending balance on my account. the balance was $900 something and they said that i had had a bounced checked for $500 dollars in may and that i had to pay the remainder of the account or charges would be pressed against me. however i do not have a bank of the west account. also i called bank of the west and they said they did not know this law office and that they would never conduct a law suit in such an unprofessional manner. also both the woman (named mrs. Hordgis) and her "legal department" (which was a man) spoke in a manner that was not at all condusive to the professionalism associated with a law office. The man then proceeded to ask for information about me and i told him that i would not be giving out my information to a buisness i knew nothing about he asked for my name and for the last four digits of my account i refused both. i told him to give me the name of the woman i was supposed to be and he was incorrect in the first name in an attempt to cover up their tracks and say that i was the wrong person. Do NOT GIVE ANY INFORMATION ABOUT YOURSELF TO THIS COMPANY THEY ARE FRAUDS AND SCAM ARTISTS. also the man ended the conversation by hanging up on me and telling  me to " call back when i learned manners", by the way i conducted this all without any deragetory behavior and or statments made on my behal. They are not professionals on any level, What receptionist say "whatever i'll just file suit, whatever"

VIA CERTIFIED MAIL

Dear {insert name of collector or company},

I am writing in response to your (letter or phone call) dated {insert date}, (copy enclosed) because I do not believe I owe what you say I owe.

This is the first I've heard from you, or any other company on this matter therefore, in accordance with the Fair Debt Collection Practices Act, Section 809(b): Validating Debts:

(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

I respectfully request that you provide me with the following information:

(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) Provide a verification or copy of any judgment (if applicable);
(4) Proof that you are licensed to collect debts in (insert name of your state).

Be advised that I am fully aware of my rights under the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. For instance, I know that:

Because I have disputed this debt in writing within 30 days of receipt of your dunning notice, you must obtain verification of the debt or a copy of the judgment against me and mail these items to me at your expense;
you cannot add interest or fees except those allowed by the original contract or state law.

You do not have to respond to this dispute but if you do, any attempt to collect this debt without validating it, violates the FDCPA.

Also be advised that I am keeping very accurate records of all correspondence from you and your company including recording all phone calls and I will not hesitate to report violations of the law to my State Attorney General, the Federal Trade Commission and the Better Business Bureau.

I have disputed this debt; therefore, until validated you know your information concerning this debt is inaccurate. Thus, if you have already reported this debt to any credit-reporting agency (CRA) or Credit Bureau (CB) then, you must immediately inform them of my dispute with this debt. Reporting information that you know to be inaccurate or failing to report information correctly violates the Fair Credit Reporting Act § 1681s-2. Should you pursue a judgment without validating this debt, I will inform the judge and request the case be dismissed based on your failure to comply with the FDCPA.

Finally, if you do not own this debt, I demand that you immediately send a copy of this dispute letter to the original creditor so they are also aware of my dispute with this debt.

This place is a collection company in Washington.

Alfalfa is 100% correct on the actions you should take!!!!!!!!!!!

I would also recommend looking to see if they have a collection license for your state if you don't live in their state.  Many collection companies fail to comply with state regulations and if their trying to collect from you and don't have a license for your state it could mean big fines.

Don't give any information over the phone.

I would add to your letter that you request all further correspondence be in writing.  You have that option.  This way everything is documented.

This is a legitimate company they have been in business for over 10 years. The behavior of one person does not condemn the whole company. Debtors will look for any way to get out of paying their debts. The first comment was a wrong person that they contacted. This is a one out of thousands of accounts they have. If contacted by them, hear them out before you end up hurting your credit and accruing more in fees.

Reading comprehension is clearly not a strong point for you.  The OP (who posted over 4 years ago, BTW) said that they did not have such an account.  The caller violated the FDCPA clearly, as stated in great detail by Alfalfa.
How 'bout you hear us out - STOP violating the FDCPA!  There will be no credit hurt or no fees accrued when you call the wrong people for debts they do not owe!  No debt validation = these peoply will pay you nothing!

Nice job, shill, reviving a 4-year-old dead thread, thereby confirming that this company is STILL a scam.  Thanks.
