I just got a call from this number and the person that I spoke with told me that there was a warrant out for my arrest for a pay day loan that I never took out and when I explained that to her and also told her that it was pretty clear that she did not understand that I don't have any payday loans out she continued to tell me yes I did and that it falls under the bad check law. I know it is a scam
These people called my Mom scaring her half to death about a legal litigation against me. So I called and spoke with a Tony Carter who states I have a worthless check in the amount of $998.84 for an online advance from Online Advance LLC taken in October 2011. I know I didn't take a loan out and told him so. When I start asking detail questions( what account number was it deposited in, what the original amount of the loan was and who could I contact at Online Advance) he got indignant with me and snapped "Are you going to pay the debt"? I said no. He proceeded to tell me that he would be processing the affidavit to issue a warrant for my arrest for worthless checks and to govern myself accordingly and hung up.
Called back asked where were they located and what companies they represent and was hung up on. Called back again and was immediately put on hold. This has SCAM written all over it. Whenever I'm ask to pay money over the phone I'm out!!!!
This number 4402711699 Call me Thursday. Saying that we are sending out a warrant for your arrest for a worthless check from a payday loan $998.84 I ask what was the name of the payday loan. All she could tell me is America LLC. Lady name Tammie Smith put me on hold transfer me to a man. He told me to go buy a debit card and put the money on it and finance department will send me a confirmation letter to my email, after the payment has been made. The name of this company is Litigation Mediation. They would hold it until August 28 after that they will send a warrant for my arrest. For a loan, never heard of getting arrested for a loan. These people need to be stopped!!
That is because no one in America has gone to debtor's prison for several hundred years after it was outlawed. Ask yourself another question, two posters on here wrote "bad checks" in the exact same amount? What are the odds of that?
This is a common ploy by criminals attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this, all for an alleged or nonexistent debt. They also use the “process server” who calls and claims he is going to serve you, but then says you could avoid it by calling another number. Now why would a “process server” want to do you, a stranger, a favor, and at the same time not get paid to deliver the papers?
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
