This SOB called trying to collect a debt for Capital One. Told my wife she should take up "GANG BANGING" to pay her bill and when she threatened him with an attorney he said "if you can afford an attorney, why don't you pay the bill before I have you put in jail?"
I'm very sorry to hear about your problem and I'd like to wish your husband my best wishes and prayers.
What you are experiencing is a bogus or fraudulent debt collector engaging in what are probably illegal practices. Tell him that he is no longer to be calling your workplace. If he does not comply he is in violation of the FDCPA. Demand that he supply you with written validation of his claims. By mail, not e-mail or fax. Demand that he supply you with a verifiable phone number and address, the name of his firm and his real name. If he refuses, he is a fraud. Tell him that all your phone calls are now being recorded. All voicemails will be as well.
He will most likely become irate and belligerent. Hang up, don't engage him in an argument. Bogus and fraudulent 3rd party debt collectors are a curse on this planet. There are consumer Attys. galore that will take on cases for people victimized by these vermin. Most will take these cases on consignment, meaning that if you have evidence of abuse there will be no fees up front. If you feel there is a need, please contact one.
If the collector does provide you with a legitimate address, send them a cease and desist letter. Just Google it. The forms are plentiful. This will only prevent them from calling. Communications will be restricted to mail. If your debt is legitimate make arrangements to pay it, but please verify it. Be sure that the collector is legitimate and that he is legally entitled to collect it. Never believe anything a debt collector tells you. Verify all information with your original creditor. Check your credit reports. Talk with an attorney if you're in the least suspicious. If money is an issue, contact your local Legal Aid people. Information and advice is available to all who go to the effort of finding it.
