It was a certified, restricted letter from this company and they wouldn't allow me to sign (it was in hubby's name) so I rejected it and called them and that's what the little gal said, they sent me a summons. The same day I did receive a letter saying hubby was being sued but if we called they could make a payment plan. I thought the fat little sheriff's deputy was supposed to deliver summons????? Please can somone advise? When I receive the papers, I am writing the attorney general office, but I would like to know if it is legit to receive a summons through the mail before I file with the AG.
In the state of Kentucky it is legitimate for a summons to be served via certified mail to out-of-state recipients. Whether this summons is legitimate or not I do not know. I suspect that it is not as you mentioned their willingness to settle. I believe they're trying to 'soften' you up.
Call your local Clerk of Court and explain the matter. Have them check their records. I'd be willing to bet that they won't have a clue who you are or who these people are.
