Please do report your caller to the FTC, FBI, Dept of Justice and your state's Attorney General. You can't be "served" via fax, email or phone/voice mail. And no one gets a heads up they'll be served either.
caller was yelling at me telling me I am being sued for something, wouldn't tell me what, than said I was formally served. she also was telling me she was coming to my work to give me papers...is that how it works? This has never happened to me before!
No, this is NOT how it works. If you were being sued you would receive a summons delivered by a deputy or a process server. Neither of which EVER call ahead of time to let you know they're coming!
Your caller is using a VERY old intimidation tactic in the hope you'll be intimidated & pay on an invalid or bogus debt. You can NOT be "formally served" by phone or e-mail. EVER!
If you take another call from them, DEMAND a notice of validation be delivered to you by mail. NOT e-mail or fax. As per federal regulation under the FDCPA. When your caller refuses, or starts blustering, case closed! Your caller is a desperate & fraudulent collector attempting to collect on an invalid, time-barred or purely bogus debt.
