You are completely wrong about what the DNC registry is and how it works. It is a list of people who do not want to receive telemarketing calls. If you receive a call that attempts to sell you goods or services it's a violation. Any call that does not do this – even if no one is on the line or if the call reaches your answering machine but does not leave a message – is NOT in violation. It's like if you get on the highway and see a police car with radar: He can't give you a ticket if you wanted to exceed the speed limit or intended to, only if you actually *do* so.
