If I could find out who they are and get a real physical address, I would sue. If you can find them and you file in Special Civil Division and get $1,000 plus legal expenses and court costs out of their hide.
The problem is, you can't get any physical evidence to make the case stick which is why they get away with it. Same thing with robo dialers, those automated messages are illegal and you can sue under FCC but tracking down the culprit and proving it is near impossible.
An automated recording ending with: "...or not a home owner or to be removed from our list. Press 1 to enroll in this program to lower your mortgage now, or press 9 to be removed from our list. It is important that lenders do everything possible to keep you in your home. Press 1 now to start the process of reducing your payments on your mortgage. Press 1 now, or press 9 to be removed from our list. Press 1 and lower your mortgage under President Obama's plan. Press 1 now."
