I believe "Anonymous" is correct on this. Plus if you were being served a summons, they do not call, they just show up. Also,a summons does NOT require a signature, just an answer, in writing, to the courts. They probably would rather you call them back and see if they can get anything(monetary) out of you, especially if the debt has passed the SOL in your state. Make sure to research when and if the SOL has been met in your state. If Anon is correct and this is a bottom-feeder, the odds are the SOL has passed. Doesn't mean they will not attempt to sue, but like anon said, it will be dismissed if you hv the proof it is an very old debt. When they continue the legal process, it is only in hopes that you won't show up in court and they win a judgement by default. 99.5 % of defendants don't show up, and end up paying even more. Also, there is a huge fine(for them) if they are calling you on a cell phone, so I would keep the messages.
This is a bottom feeding collection agency (Miller & Associates) from California chasing old debts that are past the statute of limitations. I told them to file whatever they wanted (it will cost them over $300 plus their time) and I will get it dismissed in the courtroom based on the SOL.
this agency have called my job several times and ask to speak to my supervisor and human resource are they allowed to harass me like that ( Miller & Associates)
I received a phone call from private number stating they needed me to call 626-415-7377 miller and associates. They were from Legal Support survaces and cotracted to deliver forms that my signature was needed on to my place of employment. 24 hrs to respond or they would have to continue filing. What kinda crap is this. If they needed to deliver documents they should mail a set and include serving me at my house. Plus, the cell phone they called me on is not even in my name.

They can legally call your human resource department, however, they CANNOT divulge the reason for the call. all they can do is verify that this is your place of employment, supervisors name..etc. If they even hint that they are collecting a debt, that is against the FDCPA and it illegal. This is usually a scare tactic and used to embarrass the consumer into paying a debt he/she may no longer owe. A legitimate debt collector (and there are some out there) will work with you in a dignified and respectable way.
If you want them to stop contacting you at home or work, you will have to send a cease and desist(certified) letter. If you choose to call them back, be very careful what type of info you give them concerning any "alleged" debt. And NEVER give out banking info over the phone. Good Luck.
