Baltimore, MD (Jan. 9, 2015) - Attorney General Brian E. Frosh announced today that his Consumer Protection Division entered into a settlement with Prince George's County-based home improvement contractor HomeFix Corporation ("HomeFix") and its owner, Tope Lala. The settlement resolves allegations that HomeFix placed telemarketing calls to consumers who asked to not be called on their home telephones or whose numbers were on the Federal Trade Commission's National Do Not Call Registry.
HomeFix allegedly made telemarketing calls to consumers throughout Maryland, but failed to take adequate steps to prevent calls to consumers who had registered their numbers on the Do Not Call list or who, after being contacted by HomeFix, asked the company not to call them again. As a result, hundreds of consumers complained about receiving unwanted sales calls from HomeFix. Some consumers reported that HomeFix continued to call them, even after repeatedly being asked to stop.
The settlement prohibits HomeFix from calling consumers who are listed on the Do Not Call Registry or those who ask the company to not be called. It also requires HomeFix to improve its internal safeguards to prevent placing unwanted telemarketing calls, which includes updating its technology and providing training for its employees. Under the agreement, HomeFix also agreed to pay $12,500 in penalties and costs.
