This scam has been trying to contact me for months. It's nothing but a scam.  I'm not sure what to do to get them to go away.

A real attorney
Dear Readers of these posts.

I am writing at the request of my client, who has recently received several calls from the number 718-732-0174.  The caller said that he was Justin Brooks, and that he could be reached at extension 389.  When I called on my client's behalf, I got the person who called himself Justin Brooks directly (thus, no extension number - this is a red flag, as that indicates the phone number is his direct number - also 718 prefix is a cell phone).  The man who called himself Justin Brooks had a very distinct accent, of the type where they do not name their children "Justin" - another red flag.  He said that he was calling from the Law Offices of Richard Ross and collecting on a debt owed to a payday loan company called Americash Advance. My client has never had an account with that company.

I told the alleged Mr. Brooks that I was an attorney calling on behalf of my client, that I was disputing the debt and that I was going to give him an address to send verification of the debt, if any.  He just hung up.

These calls are scams, and this is how they operate.  First, they get a pre-paid cell phone, which is not traceable.  Then, they cold call people who fit poor credit profiles and badger them into paying something, either by an electronic check, or payment on your debit or credit card.  The badering usually is by threats of criminal prosecution.  Then, once they have your account numbers, they will drain your account.

IF YOU ARE EVER CALLED BY THESE TYPES OF SCAMMERS, DO NOT FEAR THEM, AS YOU CANNOT BE PROSECUTED IN THE USE FOR OWING MONEY - REGARDLESS OF WHAT THEY TELL YOU.  THEN, you need to first tell them that you dispute the validity of the debt.  Under the Fair Debt Collection Act they must provide you with written verification of the debt within a short period of time.  IF they do not provide you with the verification of the debt, the debt is invalid and not subject to collection.  PAY NOTHING TO ANYBODY UNLESS THEY PROVIDE YOU WITH WRITTEN VERIFICATION OF THE DEBT, AND ONLY THEN IF YOU FEEL THE DEBT IS VALID - otherwise, let them sue you for the debt, as a real law firm will only bring a legal action on a truly valid debt.

The other thing that you can do, of course, is to just tell them to "[***]" and hang up on them, as there is nothing that they can do to you.

PLEASE SHARE THIS WITH YOUR FRIENDS.

Sad but True

This should be "The Eleventh Commandment".

Great advice. Thanks for sharing.
