Called claiming I had committed check fraud. Keep wasting your time calling. Even if a payday loan ACH bounced--not that it did--in my state it is not check fraud. The only remedy is civil court and to do that they have to send a VOD and give me 30 days to respond. Even then it might take three or more months to get a court date. The only PDY loan I ever took out was on the internet--it is illegal in my state to loan money unless you have a physical address and you are licensed. There are a bunch of state laws they would be in violation of; thus, they can only collect principal that hasn't been paid, and no interest. They cannot charge lawyers fees, etc. as a result. You know they monitor this site. Chew on that for awhile.
I have been receiving calls from a company called "Roth Harris and Associates", they told me that I owe debts from an old payday loan I got in 2010. I told him that I filed bankruptcy in 2013 and that it has since been discharged. He told me that the debt is still valid and that I need to pay if I don't want to be sued and go to jail. I told him that I do not have the $2100 he was asking for, and he then told me that because I claimed bankruptcy, that I would just owe the original $501.20. I told him that I still do not have that much money to pay him today and he told me that he is going to have to send my paperwork to the court today so that they can write a warrant for my arrest. I begged him asking if there was anything I could do and he told me not unless I agree to a post dated payment. I told him that I would be happy to do a payment arrangement, but only if I had a letter in the mail stating my debt. He told me that by the time the letter got to me, that it would be too late. I asked him to still send the letter because I know it is my legal right. In the end, I don't think he is going to send it and he said he sent my paperwork in to have a warrant put out for my arrest. I have done a lot of research and found that this could be a scam, or even if it is legitimate, it was 4 years ago and I have filed bankruptcy, so it is probably not a valid debt. I am just sick of them calling me and threatening me. I asked for their phone numbers and he gave me a 214-628-1409 phone number and a 800-352-7402 phone number, company name of Roth Harris and Associates, address 150 Highway 160 Ste 101132 Ft. Mills, SC 29703. I asked him to repeat all of this information and that is what he gave me. I looked up the information online after getting off the phone and could find no such business.
