Have you ever submitted a resume to a job fair or online company? Eventually, you'll get a call from these guys, who just read your resume and try to match you up with some job listing that they found. No, it's not from the company, They're middle men, looking for a fee from the company. You can search for these jobs yourself and skip all the B.S. If you don't want the job, they ask you to refer someone else !!!!

I don't think so in this case. Rather, I think that judge is saying that middlemen (possibly headhunters) are behind a lot of junk BS calls. Knowing what I do about some of these middlemen creatures, he may be right. And to say that you can skip the job that they offer and avoid the BS is true. It doesn't sound much to me that he is shilling at all, particularly if the resume is posted or circulated publicly. And these middlemen creatures DO ask you to refer someone else.
By the way, a legitimate (not a scam), typical middleman has a contract with all the companies he represents, so that if you take a job after hearing about it through the middleman, he gets paid his finder's fee if you stay at the company long enough, so you can easily argue that the finder's fee comes out of your starting salary, and as a further consequence, out of subsequent raises you might get starting from your lower base salary.
