Called about a payday loan without my knowledge I apparently took out in 2011 with westgate group. I have never, nor even considered taking a payday loan as the interest alone is ridiculous. They had my information as well as the last 4 of my SSN. I had my financial adviser talking on my behalf to Amanda from Alliance Generator and they would not provide information, or an address to send letters to stating even if it is my debt, Utah statute of limitations is 6 years and can not collect on a debt. They threatened to have me arrested at my place of employment and papers to be served as a scare tactic.... Do not fall for this as it is a SCAM.... Check your credit reports at trouble may follow with fraudulent loans, and acticity. Here is a link as well.

No, SOL means they can't sue you or threaten to sue you.  They can still attempt to collect on the debt.  No one gets arrested because they didn't pay a debt whether real or imaginary.


It is incumbent upon them under the law to prove that the debt exists and that you owe it, and that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
