Caller said a legal lawsuit was being filed against me by the IRS for Income Tax Fraud. Because it was fraud, no letter would be sent. Asked for the name of my tax attorney and said 45 minutes after call ended they would file the suit with the local courthouse and the sheriff would provide me with the case file, a legal subpoena and warrant. He stated the years audited, the 4 violations. After I questioned him for about  5 minutes in disbelief, he asked if I had been convicted of any crimes in the last 5 years. NO!  He offered to connect me with the Restitution department of IRS to attempt to work it out.  Restitution was $3764.35 and payable now since call was being recorded and all matters had to be handled before we hung up.  He stated my bank accounts and credit cards had a black mark against them for now and funds would be made by a bill payment voucher. The voucher to be used was an Apple ITunes card.

IF there really was a law suit coming, you would have a visit from a licensed process server.   The real IRS mails letters if there is a problem.   Why would the government want an iTunes card instead of cash??

Exactly, when I stated later in the conversation that I was confident that IRS would have sent a certified letter first, he said they sent one in July and since it was not accepted it was returned after 30 days and they were forced to proceed. He couldn't keep his story straight. And asking for payment with an ITunes card?!   Seriously?!

The IRS will never:
•Call to demand immediate payment, nor will the agency call about taxes owed without first having mailed you a bill.
•Demand that you pay taxes without giving you the opportunity to question or appeal the amount they say you owe.
•Require you to use a specific payment method for your taxes, such as a prepaid debit card.
•Ask for credit or debit card numbers over the phone.
•Threaten to bring in local police or other law-enforcement groups to have you arrested for not paying.
If you get a phone call from someone claiming to be from the IRS and asking for money, here’s what you should do:

If you don’t owe taxes, or have no reason to think that you do:
•Do not give out any information. Hang up immediately.
•Contact TIGTA to report the call. Use their “IRS Impersonation Scam Reporting” web page. You can also call 800-366-4484.
•Report it to the Federal Trade Commission. Use the “FTC Complaint Assistant” on FTC.gov. Please add "IRS Telephone Scam" in the notes.

•Call the IRS at 800-829-1040. IRS workers can help you.
