Hey yo. If you've got to talk to Scott Hall, which isn't advisable, ask him about Kevin Nash and his days wrestling. You're not going anywhere and it'll stop if you're able to kill unknown calls so they're unable to leave you bogus, threatening messages. No kind of answer tells the caller they've got to move on or waste a lot of time.

Okay let's play a game here. Let's read the whole thing and find out just improper This legal letter is, I'm beginning to think Mister attorney scotthall must be a sixth grader. This is a pretty good example I'm not using proper English in a formal legal letter below.

You are hereby notified that a lawsuit has been filed against you for three serious allegations. CASH NET USA is a Primary Lender.

The affidavit states that you went online utilizing your personal information which was track down by anti-fraud department, in order to solicit funds from a website which is owned & operated by CASH NET USA who owns & operates more than 350 websites, web portals(Ace Cash, Speedy cash, Cash & Go...) & sub lenders working for them. The funds were successfully transferred into your bank account utilizing an interstate EFT which stands for electronic funds transfer.

When the creditor attempted to extract the funds back from your account as a repayment, at that time 6 EFT’s were returned back constituting worthless electronic checks. So, as of now rather than chasing you for money the creditor have simply decided to write this money as a loss, as well as declared to be stolen and they pressed charges against you.

The Fair Debt Collection Practices Act (FDCPA) regulates collection agencies and places limits on what they can say and do in their attempts to collect a debt. It only applies to collection agencies, not to creditors collecting their own debts. However, if, as may be the case with you, the payday loan company is pretending to be an outside collection agency, then the FDCPA applies to them.

Even if the FDCPA does not apply, the similar (but less detailed) Texas, Oklahoma  Debt Collection Act still applies. The PDCA, TDCA, unlike the FDCPA, applies to creditors collecting their own debts.

Here are a few FDCPA rules that may apply in your case:

1. It is illegal for a collection agency to imply that they have sued you or filed criminal charges against you when they have not. To me, it looks like the collection agency violated this rule.

2. It is illegal for a collection agency to threaten criminal prosecution when they cannot actually prosecute you. In Texas, you cannot be prosecuted criminally over nonpayment of a payday loan. So it is illegal for them to claim that you have violated laws, and imply that they can prosecute you. See below for hot check rules.

Hot check rules in Oklahoma and Texas: If you bought a good or service and paid with a check, and the check bounced, and you didn't make it good, then you might get prosecuted for "theft of goods" or "theft of services" because you effectively stole the goods or services. If, on the other hand, you paid or made a payment on a pre-existing debt with a check and the check bounced, then you cannot be prosecuted for theft of goods or services.

Unless you stole the goods or services, you cannot be prosecuted for theft of goods or services. Any claim to the contrary is false and is illegal to make.

Please update your inquiry and let me know if it was just a run of the mill payday loan or exactly what the situation was.

So I called the Number 859-575-9999 and began to ask questions. He Hung up.  I keep calling but i think mr Daniel Morgan is shy folks.  If you got the text please give him a call. And if he don't answer, Just keep trying..  He must be a busy little guy working that office all by his lonesome.

And Daniel, Don't get discourged.  Perhaps you need to call your Mommy.  How long has it been since you called her Daniel??  I think that is what you need right now,  Just one of those Mommy to Son talks to perk you right up so you get back to answering the calls as they come in.

I also received this identical message at 4:30am I might add.  No attorney will text you this kind of garbage. That's what agents of service are for. You must be served when a Lawsuit against you is filed. All communication is done formally by certified mail for a reason. Even the IRS will only mail you a letter concerning any issues or pending legal matters. This is clearly BS....

Most likely originate in India and Pakistan.  Phony legalistic documents.  Stupid mumbo-jumbe.  Simply ignore and block.  There's no way to prevent the calls or messages from being initiated.  Invest in a call blocker and DO NOT pick up on call numbers you do not recognize.  Just an extortion attempt aimed at the ignorant.

Many of these scammers pick on women, the elderly and members of the i immigrant community.

I got the same text message today, but I have had these before in the past from different numbers and I know they are all scams. Plus I also know from my own experience with a debt collector that if they want to sue you for the money you owe them, they serve you court documents at your home or mail and not via phone or text message. I opened the link to a phony letter from some guy who can't type correctly because his name is scotthall, plus the email he gives is a Gmail account and if it were an actual attorney I think their email would have the name of the company or law firm they work for as their email extension and not gmail.com. Plus what they are saying I did I may have applied for a payday loan in the past, but I have never been approved to get one, so how could I have committed fraud if I never got any money from this so called company. I guess they really think we Americans are morons.

I think Daniel is now embarrassed. He will not pick up the phone. I think each and every one of us should give him a call and leave him a voicemail for encouragement.
And Daniel don't despair! I'm sure you can find another telephone number to rent. Just remember, when it first you don't succeed, try and try and try and try and try and try and try and try again.
In the meantime Daniel, try to cut some of your overhead costs. Perhaps you should not be paying for a computerized voice mail to answer your phone. You have such a wonderful Middle Eastern accent. Why would you want to disguise it Daniel with such a monotone computer-generated voice. I really don't think people would think anything of it with your accent and your wonderful American name.
