if, after sending a certified letter asking them to cease and desist, they keep calling you, you may sue them in small claims court in any amount up to $7.500, at least in california.  if they don't show up, you win by default.

Alf, I find this tangled explanation you've quoted misleading. Nothing in the FDCPA prevents one from revoking all call permission, and that is in fact done quite often while requesting validation. It's not left to collectors to decide what's "inconvenient". People who don't tolerate verbal bully tactics get to move the whole mess to a paper trail, which is advisable anyway. Taking away phone contact does not close all contact channels, and is therefore not unreasonable. A partial cease-comm also keeps the agency from feeling cornered into filing suit.

The simpler way to put it is that collection calls are permitted each day within a thirteen hour window, beginning at 08:00 in the consumer's time zone .... ABSENT instructions to the contrary. You can restrict all calls to a payphone in a drugstore parking lot between 10:15 and 10:40 on even-numbered Tuesdays. It doesn't sound convenient on its face, but that's your story and they have to stick to it.

I am racking up violations now from a certain Buffalo Bully which thinks that sending me flimsy validation means they can call any old time. They were long ago noticed by Certified mail to keep their pelting within a few hours daily, which they have repeatedly ignored. While I have meticulous CID records, all I need is to capture one live call wherein I politely tell them off before I feel ready to send a summons.

Where in the world did you ever hear that they can't call on weekends?

I think you need to brush up on some of your facts before you try to give people information that isn't true - at all!

They can't call at unreasonable hours which is prior to 8am and after 9pm daily. They also base their calling on the last known location of where you live. So, if you have moved from say California to Illinois, you're going to get calls upwards until 11pm UNLESS you tell them you have moved.

The FDCPA is NOT designed as a shield for people to hide behind. The FDCPA does NOT give you immunity and the ability to NOT be collected from. The FDCPA  DOES NOT make collections illegal nor does it severely tied their hands. Quite honestly it does say they must do it a certain way.. in most part, most of the [***] that do this job do it with in the guidelines - and yes, some push it. For most people what the FDCPA means to them is no calling late at night, they're not to swear at you, they have to tell you the proper about of the debt and validate it in a certain initial period. . It also states that they are VERY limited in what information can be said over the phone UNLESS they can validate who they are talking to - which MANY people won't. That's called hiding.. if you want to play that game, this stuff is going to continue to happen. It also says that you DON'T have to talk to them, BUT, it DOES say you must tell them, and then they're allowed to contact you once more to let you know they won't be contacting you anymore.. but that usually means, for the more serious debt collectors who have the ability over you, that they're going to talk to you through the court systems. (This is not a place you want to be with a debt collector)

And it DOES say they can talk to you only once a day. SO you idiots that think that by calling and not leaving a voice mail when they do is illegal you're wrong..  In fact, they CAN call a few times and leave a few messages if they wanted. The FDCPA allows for them to TALK TO YOU once per day. They can, however, call over and over all day long. It would be assumed that you're not home and if you're not home then the phone rings and no one hears it right? ... so, sorry, no harm done. If it IS annoying you, YOU have chosen not to answer it and that is YOUR problem. Simply answer it, confirm yourself, and then tell them you've had your one phone call and hang up. They call back, then it's a violation of the FDCPA.

Take the right steps.. learn the FDCPA.. if you really want to hide behind it then there are plenty of things you can get debt collectors on.. but coming to a message board and bitching about it and stating incorrect information as "facts" is not going to help.

In other words, stop being idiots. Debt collectors have just as many rights as do debtors. Unfortunately, when I read these posts I see that only the debt collectors are pushing their rights. It's time to change my phone number because who ever had this one before me clearly owes a lot of people a lot of money.

Hates [***] collection [***]
Eat [***] [***].  Since you are clearly a [***] eating collector at least identify yourself as such.  By not identifying yourself you just validate all the complaints made about you bottom feeders.  You are trash, I am not afraid to identify myself as someone who will never pay these [***] for the zombie debt they paid pennies on the dollar for.
