Total debt scamming operation. Being in ordinary civil debt is NOT a crime and you cannot be arrested for it. Only judges issue warrants and they are only issued to duly constituted officers of the law upon proper application. They are only served by officers of the law and are served in hand. Warrants are only used in criminal cases. Debt collectors have nothing to do with the cirminal justice ysstem. Debt collectors cannot get arrest warrants. As I say, being in debt is not a crime and we do not have debtors imprisons in the US.
Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.
If a voice on the telephone claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else a dime until the debt is validated
Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.
If they are bothering you, report them:
http://www.consumer.ftc.gov/articles/0149-debt-collection (Threatening civil proceedings with no intent to follow through, or threatening criminal process in order to collect a civil debt is a violation of the Federal Fair Debt Collection Practices Act.) The same goes for endless telephone harassment
Also contact your local attorney general
If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.
You'll probably have to yell at them and talk over them.
You have to get tuff with these people because, being akin to thugs, brute force is (metaphorically speaking), the only thing they understand.
What part of "Being in ordinary civil debt is NOT a crime and you cannot be arrested for it. " do you not understand? Did you read that post? Did you use that link to the FTC site to learn about debt collection? It doesn't look like you did. Further, how do you know this debt collector has the legal right to collect the debt? If they are threatening jail then you can be sure they don't. Since they talked to you, this is what they are now required to do:
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
Since you already have an excellent FDCPA case:
You need to send them a certified, return receipt debt validation, cease and desist calling, or "not me" letter (think of it as the best $6.47 you ever invested). Also send it first class mail in case no one will sign for it. Make a notion of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it. Use these web sites to find an attorney in your state that will probably take the case on a contingency basis (no money out of your pocket up front): http://www.consumeradvocates.org/
