Thanks to other posters for responding. I got this same call as described by the rest 1/15/15. Coincidentally, I also got a call on 1/6/15 from 818-985-2408 from an "Adam Graham" of the "Dept. of Legal Affairs". When I looked up the number, I found no listing for it so I never called it. Scary!
I got a call FROM (729) 591-6564 with a recorded message claiming it was the IRS and instructing me to PHONE BACK or they'd be filing a lawsuit. Number given for phoning back was (949) 860-1246. Since the IRS communicates by mail, it's a scam. Will report it to local law enforcement to run up the flagpole.
I, too, received a call this morning at 6:49am (I am on the west coast) from (727)596-6534 with a recorded message claiming it was the IRS and instructing me to phone right away or they'd be filing a lawsuit. The number I was to call was (949)860-1246. Since I have a clear conscience and the IRS would send out a letter with any questions they would have, I assume it is a scam and Googled the number to see if anyone else is getting the same kind of call. I'm not sure who to report this to.
Automated female recording: message saying this was the IRS and a lawsuit is being filed against me. To find out more about this case please call (949)860-1246 immediately.
DO NOT CALL THEM BACK - it's a scam!!

I also did a lookup for the local police department's general intake email for reporting non-emergency incidents, and gave them the information. When there's a spike of fraudulent calls in the area, they like to issue general warnings describing them to the public.
