I called the number back. It has a recording about allegations against me. When I tried to obtain additional information of course they could not provide it.
Don't return the call. Sounds like a garden variety debt scammer. Allegation is a term used in criminal law. Debt collectors trying to scam you by scaring you into paying them money. Debt collectors have nothing to do with prosecutions or the criminal justice system. Don't return the calls. Block them.
They told me to call lisa witherspoon within 24-48 hours about a supposed accusation against me If I didn't call back then things could be pending against me and if that happens they will not be able to help me an I am to then call m local or state authorities or an attorney. This was Friday March 20, 2015 afternoon and I have been trying to call back since and I keep getting a voicemail.
Warning signs that they do not have a legitimate claim to collect on alleged debt:
Requires immediate payment
Is seeking payment on a debt for a loan you do not recognize
Refuses to give yo a mailing address or phone number
Asks for your personal financial or sensitive information
Exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report to the law enforcement agency
Claim to be mailing you items (but you never received anything)
Says "its to late to mail anything out now"
Calls from a blocked number (Unknown, out of area, restricted)
A phone call from a supposed debt collector is not legally sufficient evidence of debt.
The Fair Debt Collection Practices Act (FDCPA) states that every collector must send you a written validation notice telling you how much you, and to whom you originally owed it to. They must also tell you that you have 30 days to dispute this claim and the procedure on how to go about disputing it.
!!!Written means they have to send it by USPS!!!! E-mail and fax is not a valid method of delivery of documents unless it is approved by the court!
Remember -- you do not get warnings about arrest warrants, the cops will just show up at your door to arrest you. Process servers will not call to see if you are home or at work because it would defeat the purpse of their job.
