A scam call claiming i owed money on a payday loan (i have never taken a payday loan) deposited into an account at a bank i have not used in over 7 years. The guy claimed to be "investigator stelling" and got quite angry when i asked him to mail confirmation of the debt. He also failed to inform me that "this is an attempt to collect a debt" and eluded to criminal charges, and proceeded to change his tune when i informed him that any debt would be a civil matter, not criminal.
First, why are you allowing him to call you at work. You should tell him that you cannot get those calls at work, and ask him for an address to send a letter stating that fact to him (he won't give it or will give a fake address). Then, you should ask him why he hasn't done the following as required by law (he will hem and haw and comup with some excuse):
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

I am not allowing him to call me at work. I have advised him several times not to call me and I have provided him with my attorney's information. Thanks I am trying to get in contact with him now to ask for a letter stating what I owe etc.. Thanks for the advise. Also, I will follow up with the atty general's office. It seems to be a scam. I have researched the # and it only states that its a landline. Plus, I cant find an atty office for Langford and Swartz.
You are welcome. But they should have sent that letter out within 5 days after they first talked to you. The fact that they are still calling you at work, that they have been informed that you have an attorney, and they didn't send the letter tells me that these are criminals masquerading as debt collectors. If they know you have an attorney and have his information, the law says that they are not allowed to call you but must deal with him. they don't want to do that because they know they have no legal grounds to stand on.
