SOL refers to the length of time they have to sue you over a debt, not on whether you still owe it or whether they can attempt to collect it.  That is the wrong thing to concentrate on, since everything in that person's post was done verbally.  The proper way to deal with a debt collector is to always make them follow the letter of the law, starting with the first dunning letter sent by US mail, and then by making them not only prove that you owe the debt, but that they have the legal right to collect.  This is all set out in a plain language Federal law.  Also, one other thing, how do you know that person is in Texas?  He said the debt collector was in Houston, he didn't say that he was, therefore the SOL might be different in his state.

You heard very typical lies from a bogus PDL collector, including the criminal charge threats, the generous discount on rapid payment, and the claim that you paid the wrong guy last time. The term you wanted was "scammer".

As BigA said a short while ago, the collector's location does not affect SoL. The debt collector did not originate the loan and did not create the lender contract. It's not really established if this "ARS" is in Texas at all. The litigation "shot clock" hangs over your head as the alleged debtor. In most cases, the state where debt was incurred by the borrower governs the SoL to apply.

These goons will never sue or jail anyone, so the SoL question is pertinent only in debunking their claims and bringing your own FDCPA action.

"ARS Management" called me ....actually it was an automated call from a local number telling me that there was some lawsuit against me for who knows what. Called back and they said they were a Third Party Mediation Company in Houston Texas. = SCAM. I had the States Attorney General's office look up the number and business....yeah they do not exist. They are calling from local state numbers, and wanting you to call back in at yet another new number:  877-466-8160. Total SCAM.

Has anyone ever actually gotten anything from their "process server"?  When I would not confirm my address and other identifying information they said "okay I will mark this as refused and a process server will be at your place of employment between 3-5 today. Goodbye" and hung up.  Do they ever actually come or what? I asked them to give me the name of the creditor or the "plaintiff" and they said they wouldn't unless I confirmed my address and other identifying info.

Real process servers do not call in advance, they just show up.  These are criminals trying to intimidate you in buying your way out of a nonexistent summons.  You can safely ignore these calls.
