No it's not the IRS. It's a scam. They try to frighten you into believing the IRS is suing you.
The IRS has an 800 number.

Got the same message on my Answering Machine that the IRS was about to sue me for some reason.  I know that the IRS only contacts people through standard mail brought by a mailman.  Scare tactic to try to get a person's personal identity information.  Do not respond to those creeps!

The caller claims to be from the IRS and a law suit is being filed against me.

This is an IRS SCAM! I threatened to contact a lawyer as I thought it was a scam and they hung up. DO NOT GIVE ANY PERSONAL INFORMATION
