Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

Amazed
My son received a call from 832-572-3001. A lady who claimed to be an investigator for Timothy Hoffman Law Firm told my son that bench warrant will be issued for unpaid $600 Pay Day loan. This lady, who called herself, Investigator Tanya Gomez, told me my son will be charged with 4 different felony charges, including defrauding company to steal money, intent to commit banking fraud, and other felony charges. He even received a call from some guy who said he was a detention center officer saying there will be a bench warrant out after 4:00pm.  The call fro so called Detention Center gave away their legitimacy and revealed their scam. I have never heard of a law enforcement officer notifying criminals that they are going after them. When I called to validate their claim, this so called Investigator Gomez lady went right along with my BS thinking they are going to receive some money from my son or me. She told me her employer, Timothy Hoffman, is out of his office attending a murder case trial. Ummm.... so he handles murder cases and debt collections. He must be a very busy attorney. I am sure he is going to make a lot of money trying to collect $600 from my son while he attends high-profile (this is what Investigator Gomez said) case that pays much more than meager $600 collection fee he is going to receive from a PayDay Loan Company. Investigator Gomez instructed me to tell my son "Do NOT go back to the Pay Day Loan company he borrowed his money to make an arrangement to pay back the debt. Because the entire case is now in the hand of District Attorney's office. Because of this dumb attempt to make some money from my son, they wasted 2 hours of my time. When I called Detention Center and Sheriff's office to validate the detention officer's credential, there is no one that matches name he used (Officer Regional Crawford) or badge number 7122. Since they got Law Enforcement involved, they took down our complaint and also asked us to contact our state's Attorney's General office. I plan to go after these people for their scam and use every resources I can get to have them shut down the operation. It is awful to steal money from unsuspected people. I am wondering how many people actually sent in money thinking they were going to jail.

PLEASE NOTE THAT THERE IS AN ATTORNEY NAME MR. TIMOTHY HOFFMAN WHO PRACTICE IN AMARILLO TX. I AM SURE HE IS NOT THE TIM HOFFMAN THEESE PEOPLE ARE SAYING THEY WORK FOR.

W.P.
Was just scammed by Mr. Timothy Hoffman and his investigators and processing company. We almost had heart failure thinking my husband had Felony Warrants on him and needed to pay $1,026 back or go to jail. They do their homework very well because they knew enough about my husband to be convincing. After a call to our D.A. office, Sheriffs Office and Warrants Division and found out my husband is free and clear (we knew already) but it took 30 years off our lives. Please someone stop these people.

Same story!
Same calls from Detective Alicia Blair and Timothy Hoffman. Claiming I need to pay $1200 or got to jail for several charges have a 35000 bond and have to pay 3,500 to get out of jail. Called a lawyer and they stated it is a scam and it is illegal for collectors to lie about who they are. They are now calling from 361-237-1780.
