Called my husbands cell phone and said they have a summons for a court hearing for me and gave a case number. I returned the call and a recording states they are on another call and asks you to leave your full name and your case number and they will get back to you in a 24 hour period.

It's really bad business practice to talk to strangers on the phone about legal matters! This call is a scam, intending to scare you into giving away your money to the scammer.
It might take a week or so of ignoring them before they stop calling - but don't talk with them!
If someone is sueing you for real, you WANT them to serve the legal papers so you'll have all the details in writing. Plus, you can't pay money to get out of legal action - that's the crime of bribery! To settle out of court involves lawyers and at least one meeting.
