I received this via email today.  How do I get them to stop???  I called the number and they wanted more information from me which I did not give.  I demanded they email me the documentation proving I took out that loan.  I will probably never receive anything.

Here is a simple question: Do you really want the IRS poking around your tax returns to see if you claimed that money as income? Wouldn’t it just be easier to pay your bill?

Your first problem is the E mail.  they are required to send the documentation automatically through the mail, at which time you then request them to validate the debt (in writing sent by certified, return receipt mail) proving that you owe it and that they have the right to collect it.  the threat of the 1099C is counter productive for them for two reasons.  First, they would have to divulge who they are and where they are located to the IRS, assuming that they have the right to send in a 1099C.  Second, it then becomes income on which you pay tax, nothing more, probably 15% or less unless you would be in a real high tax bracket.  Also, at that point it becomes totally uncollectable by anyone.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

This is email I got. Is this for real?
