Bothered, Please clarify exactly what you are expecting the DNC to do for you on this call. If you are expecting to be immunized by the DNC to all calls that you do not want, then the DNC is not going to work for you. The National DNC was established in 2003 for one purpose only. That purpose was and still is, to give citizens an option as to whether or not they want to receive Telephone Sales solicitations on their personal telephones. ( Telemarketing=Telephone sales of goods or services. )
Your caller is a scammer or a scofflaw since it is illegal to Robo Call cell phones, a violation of the FCCs laws. It is not a violation of the DNC to call a cell phone because they do not wish to receive calls. Not until you tell them to cease calling you. Keep in mind that the DNC does not give anyone immunity to all unwanted callers. It is only "A List" of those who do not wish to be Telemarketed, (see definition above) that is required to be purchased by those legitimate businesses who use telemarketing as a sales tool. That's all. Charities, certain non-profit, political, surveys, informational, and more are exempt from the DNC. Scammers and Scofflaws such as the one calling you, are going to call regardless of the DNC or anything else. Robo calling of a cell phone is illegal in all states as it should be, but all unwanted calls are not. I know that this is not what people want to hear, but I am just telling it like it is, as is A. Most just don't understand the DNC and it's intended function and have never fully explored the DNC/FTC site for clarifying information. So many people will post here in anger over their unwanted caller, complaining about the DNC with no idea of its function and purpose. I don't blame them. It makes me furious when the phone rings only to find someone violating the law and unwantedly calling me. But I do understand the intended purpose as well as the limited capabilities of the DNC.
