Called saying that I am being taken to court for a payday loan from 2009. Said they were RG Financial. Never received anything in the mail. I do not recall taking out any such loan in that time frame.  Attorney told me even if I did still owe something, statute of limitations in PA is four years.  If they were legit, they would have to provide documentation.

It is against the law to threaten court if they don't intend or don't have the ability to take you to court.  2009, that loan might be out of the Statute of limitations depending on which state you are in:  http://www.nolo.com/legal-encyclopedia/statut ... hart-29941.html

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
