some girl named amanda stating she works with the sheriffs department they are a scam and lying to get your $ on out of stat files which you dont have to pay because they are out of stat
I filed chapter 7 bankruptcy in April of this year and it discharged in August. I just received a call from a Carol Hughes stating that there has been a claim filed against me for wage garnishment for a Kay Jewelers credit card that was included in my bankruptcy and that they will garnish my wages if said jewelry is not returned. The have so long once a bankruptcy is filed to get in contact with my attorney or the courts to agree on any terms which they did not. So how can they come after me now??? Oh and they said the company name was Thelman Thelman and Associates.

A phone call, email or text message from a supposed debt collector is not legally sufficient evidence of debt.
The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:
* Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. ["Written" means snailmailed ... not emailed or texted]
Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via green dot, Western Union, or other untraceable means, then the call is definitely not legitimate.
