I have 4 mortgages on 4 pieces of investment property which are automatically paid between the 12th and 13th of each month and have been for over 4 years.
I was told by the collection department that my payment was due on the 1st and late after that.
There is no late fee unless payment is received after the 17th of the month, so I have never been late.
So, I informed her that Nationstar had just had their last conversation with me and blocked the number.
FYI: The telephone conversation in which a collector stated that my payments were late were missleading and, should, anyone else receive such a claim, is a violation of the Fair Debt Collection Practices Act (FDCPA) which makes it illegal for a collector to make false or misleading claims. An action may be taken in any court of competent jurisdiction and the violator is liable for $1000 per violation plus REASONABLE ATTORNEY FEES. The reasonable attorney fees part of the FDCPA is the killer. I have a number of investment properties and they are a minor issue and I don't have time to go after their dumb [***]
