Several things.  This appears to be a charity.  Since they are not technically selling anything they are not required to scrub their call lists with the DNC, which you would have known had you read this:  What the Do Not Call lists covers and doesn’t cover and why:  https://www.consumer.ftc.gov/articles/0108-national-do-not-call-registry
In order to take "legal action", you will need the following:  the name of the company calling you, their address so that they can be served, and you will also need legal standing in court to sue them.  This means in part that they must have violated some section of a law, and that you can prove it.  I suggest that you take the time to read what is on that link.

I got a call from 586-571-0290 asking for me by name.  I asked who was calling. She told me she was from "Giving Hearts," a charity that will be in my area with 2 related window companies "for absolutely no cost."  I asked where she got my number; she said "why?"  I told her that I'm on the do-not-call list.  She said "we are exempt from that because we are a charity."  I asked again where she got my number.  "Why?"  I said because I want to know who violated my rights by giving her my number.  She said "We are a charity, we're not violating anything."  I asked again where she got my number.  She answered again "why?"  And I told her again that I wanted to know who was giving out my phone number.  She didn't say anything, so I said "I'll change my question:  Do you know where you got my number?"   She said "it's a secret."  I told her never to call again, hung up, and added the number to my spam listing in my phone.
This is a total scam by a non-charity who is trying to circumvent do-not-call requirements for telemarketers.
