Federal Court does not require a lawyer. Now if you are referring to the fact that you don't feel qualified to write out the complaint and file it in Federal Court that is something completely different. There are a multitude of problems with filing a case like this in small claims court. For starters, it is Federal law which technically should be argued in Federal Court. Also, small claims court judges might not be qualified to know every aspect of Federal Law. Even further, if you do win your case, and the company is not in your state, you now have the problem of how to collect across state borders, which you already pointed out.
Now, you could probably find a lawyer that would take this case on a contingency basis, making you put no money up front, and then all you would have is a couple hours of your time. Or you can do it your way and see what happens. Good luck.
No lawyer is interested in suing telemarketers but there are plenty willing to defend them. Google it. Miss doting an "i" and you lose the case in Superior Court. Small Claims court is casual. I have won a few judgements in small claims court. I cite the law in my complaint and bring a copy to court in case a judge needs a reminder. The other side gets advice from lawyers who teach them to throw all kinds of baloney out as arguments. I speak from experience and research.
So you claim you have successfully sued telemarketers in another state, won your case, and collected on the judgement with no problems?
