I got a call from this number 321-549-3042 and other numbers such as 770-240-0000, 713-292-0134 and even 847-221-0024 all having the strangest preset voice message to log onto a FAKE WAMU website. I DON'T EVEN HAVE A DEBT WITH ANYONE! POEPLE DO NOT LISTEN TO THEM OR ENTER ANY INFORMATION!!!
Washington Mutual Bank in efforts to collect a debt in the State of California, although an original creditor, is in violation pursuant to State of California Fair Debt Collection Practices Act, to wit, Rosenthal Act under California Civil Code Section 1788 et seq., by making repeated unsolicited telephone calls, whereby causing the phone to ring repeatedly and not engaging in conversation with the recipient of the call.
I PLAN TO FILE SUIT AGAINST WASHINGTON MUTUAL IN UNLAWFUL AND ABUSIVE DEBT COLLECTION PRACTICES. PERHAPS A CLASS ACTION SUIT NATIONWIDE WOULD HELP WAMU REALIZE THE NEED COMPLY WITH EXISTING LAWS.
You can not sue a credit card company or any creditor due to a blanket exemption clause in the law. You can only sue the debt collectors for that. The banks can due what ever they want. Here look it up. It is in title 15 USC 1692 ss (a)(6)(a). Wait until you get sent to collections then sue the collector!
I got calls from 509-481-9106 (WA) 847-221-0024 (IL) 412-595-9025 (PA) 626-534-0250 (CA) 602-3580120 (AZ) and 617-449-0075 (MA) for being 44 days past due on my WAMU credit card. But... you know what? I HAVENT PAID MY BILL!! They've only called once a day.
In their defense, I called them and made a nominal payment until I can fully catch up, and they were very nice about it. Bottom line... I need to pay my bill!
