These people are calling and leaving me messages about a pending case. No name, no details.
I just ignore it as I believe must be scam. Please give info about this if you have any.

Have called several times but I've ignored.  The latest one came this morning from a woman named Rachel Collins claiming to be in the State of Texas.  The phone is registered in NJ.  She wanted to verify information and I refused asking her who the company was, and particulars about why she was calling.  Told me that I was being investigated for check fraud (I have no connection with anything like this at all) and a case was pending in Minnesota.  The more I played along with her, the faster she started talking and finally hung up on me citing my lack of cooperation with the Privacy Act.

Some Payday Loan lenders will attempt to convince the borrower that the check they left is fraudulent, and the lender will file a fraud case.  Borrowers should read this:

The important paragraph in that PDF is:
"... if the small lender knew, at time of receipt, that the account had insufficient funds, or that the check was postdated, the issuer has not committed the crime of Check Deception"

(Although that is a citation from Indiana law, the laws are similar in most  states that permit payday loans)

Here is a citation from the Uniform Commercial Code (UCC), which is valid in ALL 50 states:

Section 3-104(2)(b) of the UCC, defines a check as “a draft drawn on a bank and payable on demand.” A postdated check, since it is not payable on demand, does not satisfy this demand. Consequently, it has generally been held by most states that the giving of a post-dated check does not constitute a present fraud nor is it within the scope of the bad check laws.

Yes, borrowers should pay their debts, but lenders must (by law) follow the correct procedures to collect those debts.  A summary of the Fair Debt Collection Practices Act (FDCPA) is here:

Recieved call at 9:56am, Feb. 3.  Something about a payday loan.  Told him I didn't want to hear about it.  Said they would contact me physically and hung up.

I've been receiving multiple calls from this number for the last few days (I see others have as well)... They claim they're from check mediations and need to speak with "you" immediately about a pending case. They don't say WHO they need to speak with or what the case is supposedly about. They leave me many voicemails and call at all hours of the day. They used to call from another number way over in the middle of the night and my husband finally got mad enough to answer and cuss them out. Had no further calls from the other number and now this one is blowing up my phone. I wanted to warn you about these types of calls as I used to get them years ago and they told me they would have me arrested if I didn't pay them $1000s of dollars on a payday loan. Do a little investigating scammers! In the state I live in, the largest payday loan you can borrow is $300!
